These Website Terms and Conditions govern the general use of the bergmaker.net Iceberg Charts site, operated by Nathan Jolly (“The Operator”).

Any use of bergmaker.net by you constitutes acceptance of these Website Terms and Conditions.

The Operator may vary these Website Terms and Conditions at any time. Amendments will be effective upon posting of updated terms to bergmaker.net. Your continued access after such posting constitutes your consent to be bound by the Website Terms and Conditions as varied. You may cease using the website if you do not agree to the variation.

Warranty and Disclaimer

This website is provided on an “as is” basis, with no warranties express or implied. To the extent applicable by Australian law, The Operator will not be liable for loss or damage of any kind in connection with your use of this website or its content.

The Operator provides no guarantee that this website will be free of disruption or error, and no guarantee of continued service. The website may become unavailable, functionality may change, or the website may be discontinued at any time.

The Operator makes no guarantee that your content on this site will remain available, or will continue to look the same over time. Charts may be removed for any reason (including operational reasons, or to comply with the Acceptable Use or Moderation restrictions below), at any time, and without notice. Keep your own copy of anything you would mind losing.

Accounts

Browsing and viewing charts requires no account.

Creating or editing one requires signing in with GitHub or Google. You are responsible for what happens under your account, and you may stop using it at any time by signing out. Note that the two are separate accounts — see the privacy policy.

Any personal information collected will be used, disclosed and held in accordance with the accompanying Privacy Policy.

Users must be over the age of 13, or over the age of digital consent in your jurisdiction, to create an account.

Cookies

This website uses cookies that are functionally necessary to operate the site, details of which are in the privacy policy. If you disable or delete cookies, some parts of the website may not function properly.

Copyright and ownership

The Operator asserts copyright of content on this website that is not user-generated, subject to any third party rights.

You keep ownership of what you create. By publishing a chart here you grant The Operator permission to store, display and distribute it via this website, as required to show it to readers.

You may remove content that you create at any time while logged in. Your content may also be removed by a Website Moderator (see Acceptable Use and Moderation) - please keep your own copy of any important data.

Only post material you have the right to post. Even a list of titles can reproduce someone else’s work. You are responsible for ensuring that any copied or adapted content is correctly licensed and attributed.

Charts rendered in a poster layout carry the website’s watermark; please leave it in place when sharing an image of a chart.

Licensing

Each chart carries its own terms, chosen by the person who made it and shown on the chart itself. These terms do not set a single licence for the whole site, because the site does not own the charts and cannot license them on their authors’ behalf.

The choices are:

• Unspecified, which is the default. The author keeps all rights, and the chart simply shows who made it. Ask before reusing one.
• CC BY 4.0: anyone may reuse and adapt it, including commercially, as long as they credit the author.
• CC BY-SA 4.0: similar to CC BY 4.0, except that anything built from it has to carry the same licence.

Choosing a Creative Commons licence grants those permissions to everyone in advance, and cannot be taken back from copies already made under it.

A chart may include an attribution, showing a link to the work it was adapted from and its author. This is specified by the chart’s creator, and is not verified.

Acceptable Use and Moderation

You must not use this site to:

• Post unlawful content, or content that harasses or targets a person
• Impersonate someone else
• Infringe copyright, or reproduce a substantial part of someone else’s work without permission
• Provide intentionally deceptive links to external content
• Attempt to break, overload or gain unauthorised access to the service, or work around its rate limits
• Scrape the site in a way that degrades it for other people

The website allows both chart editors and Website Moderators to flag content as "not safe for work" (NSFW). NSFW content will not be visible during navigation unless the "Show NSFW content" option is selected. This setting exists to improve the navigation experience for users. All terms in this policy apply, regardless of the NSFW setting.

If you believe that a chart violates the Website Terms and Conditions, you can report it using the Report button available on that chart. You do not need to be authenticated to use the Report feature.

Reported charts will be assessed by a Website Moderator. A chart that is determined to violate the Website Terms of Service will be blocked, removing its content and making it unavailable to all users.

Users that violate the Website Terms of Service may also be banned, temporarily or permanently, from creating and modifying charts.

Links to Other Websites

This website may contain links to other websites. The Operator does not accept any responsibility for any linked websites. Access to any external links is at your own risk.

Governing Law

The laws of the State of Western Australia, Australia govern these Website Terms and Conditions and any agreement formed under them. You and The Operator submit to the non-exclusive jurisdiction of the Courts of the State of Western Australia, Australia.
